> Precept three: malicious tale-bearing. It possesses six conditions: First, it is a bhikṣu. Second, one speaks of base and wicked matters. Third, one conveys them between this party and that. Fourth, one has the intention to cause division. Fifth, the words are distinct. Sixth, \[the other\] hears and understands. The vinaya says: malicious tale-bearing means setting this party against that to cause disturbance, making them break apart. The \*Mahāsāṃghika-vinaya\* says: Informing with bad matters, saying, 'So-and-so said you are such,' without distinction of high, medium, or low matters, intending to make the other separate \[from them\] and turn toward oneself; whether they separate or do not separate, both incur a pāyattika. The \*Sarvāstivāda-vinaya-vibhāṣā\* says: If having spoken, one speaks again, it is a pāyattika. If one does not convey the words between this party and that, but merely speaks on both sides to cause them to disband, it is in all cases a duṣkṛta. In the vinaya, cases of non-offense are: breaking up bad spiritual friends or bad factions; or when an upādhyāya, fellow master, relative, or friend acts without benefit toward the saṃgha and stūpas; breaking up all such people is not an offense.
