> Precept seven: Speaking of gross offenses to an unordained person. The Sarvāstivāda-vinaya-vibhāṣā states: "One would rather destroy a stūpa and break an image than speak of another's gross offenses, for that would destroy the Dharma-body." Regardless of whether the other monk is guilty or not guilty, in either case it is a pāyattika. Seven conditions constitute \[the offense\]: first, it concerns a bhikṣu or bhikṣuṇī; second, they have committed an offense of the first two classes \[pārājika or saṃghāvaśeṣa\]; third, one knows of the transgression; fourth, there is no allowance by the saṃgha's formal procedure; fifth, one speaks of it to an unordained person; sixth, the words are distinct; seventh, the other person hears and understands. The Pañcavargika-vinaya states: "If a bhikṣuṇī speaks to a layperson of any ordinary minor fault of the saṃgha, in every case it is a pāyattika." The Mahāsāṃghika-vinaya states: "If someone asks, 'Has such-and-such bhikṣu committed sexual misconduct or drunk alcohol?', one should answer: 'He should know for himself.' If a formal procedure has already been performed and someone asks, one should turn the question back on them, saying: 'Where did you hear that?' If they answer, 'I heard it at such a place,' the monk should say, 'I also heard it at such a place.'" When a laywoman came to the monastery, the group of six pointed out to her: "This person has committed a saṃghāvaśeṣa." The laywoman spoke a verse: / "Having gone forth long ago, / you ought to cultivate pure conduct; / if boyish play does not cease, / how can you receive people's donations?" / The Daśādhyāya-vinaya states: "If someone scolds, 'How could there be such a foolish person in the Buddha-Dharma?', one should reply: 'Our family is vast and has all kinds \[of people\].'" The Vinaya states: "If one speaks of the upper two classes, it is a pāyattika; if one speaks of the lower classes, or speaks of one's own offenses, or speaks of offenses of the lower three assemblies, in all cases it is a duṣkṛta." Furthermore, there are five matters: whether one mentions the name, clan, clothing, dwelling, or physical appearance, it is in every case a pāyattika. Non-offenses: if one did not know; if one perceives what is gross and evil as not gross and evil; or if the layperson had already heard of the gross offense beforehand—in all such cases there is an allowance.
