> Fifth, regarding incomplete conditions: If the first condition is lacking: If one is completely unaware, one incurs a grave preparatory offense, because vinegar and the like do not cause stupor and derangement in others. If one later finds out and feels joy, it is minor; if one feels remorse, it is grave; and if doubt is accompanied, it is a grave preparatory offense. If the second condition is lacking, there are three cases: 1. If fundamentally confused, altogether no offense is committed; if one later finds out and feels joy, it is a grave preparatory offense; if one feels remorse, there is also no offense. 2. If the perception shifts, it is a minor preparatory offense, because the prior intention existed; if one later finds out and feels remorse, it is minor. 3. If there is doubt, it is also a grave preparatory offense; if one later finds out and feels joy, it is also a grave preparatory offense, because only a slight aspect of mind is lacking to constitute a major offense; if one does not rejoice and feels remorse, it should be slightly lighter. If the third condition is lacking, one incurs a minor defilement offense, as in the text below: passing it to another leads to five hundred lives without \[hands\], etc. If the fourth condition is lacking, there are two meanings: 1. One incurs a grave preparatory offense, because not receiving the price does not constitute selling; 2. It is a full grave major offense, because the offense of giving alcohol to people exceeds that of taking the price. If the fifth condition is lacking, one incurs a grave preparatory offense, because being forcefully robbed by another does not constitute selling. If the sixth condition is lacking, it is also a grave preparatory offense, because if the other person does not drink it, it does not constitute selling.
