§ 313. The in c a p a c i t y referred to here was the constitutional incapacity. We have already seen that the king had no option to veto a measure decided by the majority of the council (\*Arthaśāstra\*). In an ordinary matter for which the king did not call a general Council and which went through the Ministry only, when it had been discussed and finally signed and sealed as a resolution by the Ministry as Council it really became a resolution of the Council and the King was truly, as the Śukranīti says, \*akshama\* or incapable of criticising it. The first submission to the king from the ministers in their individual capacity seems to be an opportunity given to the king to discuss the matter and to make his suggestions.
