38.38

案僧亮曰：謂在三者，從地得罪。若不墮此三者，闡提斷善根，故無從地得罪義也。僧宗曰：第三意證殺所以無罪也。謂三種之中，必因殺而有利者尚無有罪，何況不墮三種殺中而有罪耶？

Sengliang comments: It means that those within these three incur guilt on account of the field. If one does not fall into these three, an icchantika has severed their kuśalamūla; hence, there is no sense of incurring guilt on account of the field. Sengzong says: The third point proves why killing incurs no guilt. It means that among the three kinds, if one who is killed necessarily brings benefit through that killing, there is still no guilt—how much less can there be guilt if it does not fall into the three kinds of killing?
