The seventh saṃghāvaśeṣa precept: Building a hut with an owner without designation by the saṃgha. The intention behind the prohibition is the same as before. Six conditions constitute an offense: 1. there is an owner; 2. it is built for oneself; 3. the hut exceeds six spans of the Buddha in length and four spans in width; 4. there is no designation; 5. one perceives that there is no designation; 6. as soon as the building is completed, an offense is committed. This hut belongs to one's own person; if one dies or goes far away not to return, one may dispose of it as one wishes: if giving it to the Three Jewels, relatives, friends, or laypersons, or selling it oneself for money, one may act entirely as one pleases; only, one must not sell the land, for the land is saṃgha property, and the saṃgha does not permit its sale; [if sold], the monk who sold the hut incurs an offense. If the hut owner does not dispose of it himself, it belongs to the cāturdiśa-saṃgha and is inhabited in order of seniority. In the Vinaya, obstructions and hazards incur two duṣkṛtas; regarding the failure to request permission, there is one saṃghāvaśeṣa offense. Under the exceptions: if it has been designated; if one makes a grass hut, a leaf hut, or a small hut just large enough for the body (meaning it does not exceed the measure), because it is small one need not request designation; or if one builds a dwelling place for multiple people, all are permissible.
