Fifth: The owner [whose property is taken when] arresting and binding thieves. The Mahāsāṃghika-vinaya states: If the authorities have not yet confiscated it and have not yet recorded an inventory of the property's descriptions, and it is consigned to a bhikṣu, he may take it; if it has already been confiscated, he may not. If [the person] says he is giving it to the Buddha, stūpa, or saṃgha, he may take it; he must bring it out openly and visibly, and must not conceal it. If someone asks, he should say it is the Buddha's property, the saṃgha's property, or my property; if they do not permit it, return it.
