[On the passage in the] treatise: 'If she has already been promised to another […] it is all incurred against the king': This is the answer. 'This' refers to the maiden; 'the rest' refers to another's wife and so on. Although the offense is incurred against particular individuals, it is all concurrently incurred against the king, because he does not condone or permit it. This does not contradict the Nyāyānusāra. Speaking in general, it is against the king; specifically, it is indeterminate. The Nyāyānusāra relies on the specific, whereas here it speaks in general. Fascicle 113 of the Vibhāṣā states: 'Question: If one engages in impure conduct with a woman who is a guest or lodging traveler, against whom is the offense incurred? The correct statement is: it is incurred against the king. Question: If one engages in impure conduct with a courtesan, against whom is the offense incurred? Answer: If one gives the price, it is not incurred against anyone at all. If one does not give the price, it is incurred against the king.'
