88.41

第三婬戒者。邪婬有四處。一男。二女。三黃門。四二根女者。人女非人女畜生女。男者人男非人男畜生男。黃門二根各有三種同前。若優婆塞與人女非人女畜。生女三處行婬。謂口大小便處。犯不可悔。若人男非人男畜生男黃門二根二處行婬。謂口及大便處。犯不可悔。若發心欲行婬未和合者。犯不可悔罪。若二身和合止而不婬犯中可悔。除其三處餘處行婬。此皆可悔。若人死乃至畜生死者。身根未壞。於彼三處共彼行婬。犯不可悔。輕處同上。若優婆塞雖不受戒。犯佛弟子淨戒人者。雖無犯戒之罪。然後永不得五戒八戒乃至出家具足戒。若顛狂心亂痛惱所纏不自覺者不犯。

Third, concerning the precept against sexual misconduct: sexual misconduct occurs in four places: first, men; second, women; third, eunuchs; fourth, hermaphrodites. 'Women' means human women, non-human women, and animal females. 'Men' means human men, non-human men, and animal males. Eunuchs and hermaphrodites each have three kinds, as above. If an upāsaka engages in sexual intercourse with a human woman, non-human woman, or animal female in three orifices—namely, the mouth, the urinary tract, and the anus—he commits an unpardonable offense. If he engages in sexual intercourse with a human man, non-human man, animal male, eunuch, or hermaphrodite in two orifices—namely, the mouth and the anus—he commits an unpardonable offense. If he gives rise to the intention to engage in sexual intercourse, even before uniting, he commits an unpardonable offense. If the two bodies unite but he desists without having intercourse, he commits a medium, pardonable offense. Engaging in sexual intercourse in places other than these three orifices are all pardonable. If a human dies or even an animal dies, and the bodily faculties are not yet decomposed, engaging in sexual intercourse with it in those three orifices commits an unpardonable offense; the lighter parts are as above. If an upāsaka, even though he has not received the precepts, violates a disciple of the Buddha who keeps the pure precepts, although he does not commit the offense of breaking precepts, thereafter he can never receive the five precepts, eight precepts, or even the monastic full ordination. If one is mad, mentally disordered, tormented by acute pain, and unconscious of one's actions, it is not an offense.
