Kautilya's Arthashastra 7.5.22

7.5.22

adaṇḍanaiś ca daṇḍyānām adaṇḍyānāṃ ca daṇḍanaiḥ /
agrāhyāṇām upagrāhair grāhyāṇāṃ cānabhigrahaiḥ //

by not punishing the guilty and severely punishing the less guilty; by arresting those who are not to be caught hold of and leaving those who are to be arrested;
