kāraṇapratipattyā ca pūrvapakṣe virodhite /
abhiyuktena vai bhāvyaṃ vijñeyaṃ pūrvapakṣavat //
Where the defendant has evaded the plaint by means of a special plea, it becomes incumbent on him to prove his assertion, and he is placed in the position of a claimant.
