In the above statements which are mere translations of the *Arthaśāstra* texts, we find infalliable testimony as to the use or application of torture as punishment only after the guilt is *proved* and never to *doubtful* cases. Monahan thus speaks of both things at one and the same time. We are not able to follow him in this respect. The texts certainly warrant our statement that action could be taken only in the cases where the guilt had been brought home beyond any question and on the solid rock of evidence.
