c8.188

After consulting the various pertinent texts the Mit. (on Y. 2, 258) has developed the theory that in the case of a ware already tested the purchaser is entitled to cancel the purchase within three days if the price is extraordinarily high and the seller may cancel the sale within three days if the price is extraordinarily low; in the case of wares which have not yet been tested the purchaser is entitled to annul the purchase during the period of testing on the discovery of some defect; in the absence of any such ground however, even during the fixed period and in all cases after the expiration of that period, a penalty of 1/6 of the price should have to be paid when annulling a sale or purchase.
