in pawn, he ought to enjoy the gain from the land, whether he be Hindu or Muhammadan, on condition that in case of mortgage he has received permission [to till] from the mortgagor. Therefore, collect from him the portion [previously] fixed as the assessment on that land. But this portion ought not to be more than one-half nor less than one-third.
