In the conditions, regarding the fifth, "not waiting until one speaks": the commentary states, "The Prātimokṣa saying 'spoke to others' is based on the listener's intention; as for determining the offense, simply hearing it incurs the offense. If one had to wait until speaking to others, it would fall under divisive speech." It also states: "In divisive speech, a dispute does not yet exist; merely listening does not necessarily give rise to it, and it only exists when one speaks. Here, a dispute already exists; going to eavesdrop is certain to give rise to it; therefore the prior prohibition is profound—how could one wait for them to speak?"
