If he employs means to kill a human being as described above, but [the person] does not die, it is a sthūlātyaya. If he kills a non-human, or an animal endowed with intelligence that understands human speech, or one able to transform its shape, employing means to kill them, both are sthūlātyayas; if it does not die, it is a duṣkṛta. If an animal cannot transform its shape and he kills it, it is a prāyaścittika. If it is an actual human being and he perceives it as human, it is a pārājika; if he perceives it as a non-human or has doubts, it is a sthūlātyaya. The characteristics of offenses for the four assemblies are as stated above. Cases of non-offense: throwing a knife, staff, tile, or stone, and accidentally striking and killing someone; or while managing construction of a room, accidentally dropping wood or stone and killing someone; or while supporting and escorting a sick person, going back and forth into a room, if death occurs entirely without harmful intent.
