3.31

大德僧聽！此某甲比丘犯罪。諸比丘問言：「汝今自知犯罪不耶？」此比丘即以餘事報諸比丘言：「汝向誰語？為說何事？為論何理？為我說？為餘人說？誰犯罪？罪由何生？我不見罪！」若僧時到，僧忍聽，當名某甲比丘作餘語。白如是。（作是白已，名作餘語。若未白前作餘語者，一切盡突吉羅；若作白已作餘語者，一切盡波逸提。）

"Let the saṃgha, bhadantas, listen! This bhikṣu so-and-so has committed an offense. When the bhikṣus asked him, 'Do you now know for yourself whether you committed an offense or not?' this bhikṣu immediately responded to the bhikṣus with unrelated matters, saying, 'To whom are you speaking? What matter are you talking about? What principle are you discussing? Are you speaking for me? Are you speaking for another? Who committed an offense? From what did the offense arise? I see no offense!' If the time has arrived for the saṃgha, and the saṃgha approves, it should declare bhikṣu so-and-so to be engaging in prevarication. This is the ñatti." (Once this ñatti is made, it is termed prevarication. If one prevaricates before the ñatti has been made, all [such acts] are duṣkṛtas; if one prevaricates after the ñatti has been made, all [such acts] are pāyattikas.)
