又有聽制功德過失者，如律中說不得上過人樹等，依制不上是功德，違上是過失，若為命難聽上無罪。

Furthermore, there are "allowances, prohibitions, merits, and faults": as stated in the Vinaya, one must not climb a tree taller than a man, etc. Refraining from climbing based on prohibition is a merit; violating this and climbing is a fault; if for the sake of danger to life climbing is allowed, there is no offense.
