Therefore, the commentary of Jinamitra also says: The fundamental consciousness constantly operates and need not be distinguished. The retribution indeterminate mind of the sixth mental consciousness is called the fruition mind; it constantly operates across the three times of death, rebirth, and abiding by its own nature. Because at death and rebirth it is unclear, it is a fruition mind. In the Maulī Bhūmiḥ, among the six states where the six consciousnesses do not operate, death and rebirth are not stated as non-operating. Therefore we know that at death and rebirth there is the retribution mind of the mental consciousness. All minds that arise spontaneously by their own nature from rebirth onward are fruitions of the six consciousnesses; the remaining three indeterminates, as well as the wholesome and defiled, are arisen through purposive effort and do not arise spontaneously by their own nature, so they must be excluded.
