In explaining "having offenses," for the second, "due to instigating": instigating bodily or vocal [action]; there is no non-learner who commits an offense, because with respect to defiled offenses, neither [type of offense] is committed. With respect to undefiled offenses, although they do not commit them intentionally, there are also mistaken transgressions. The Treatise on Elucidation says: "When a non-learner commits an offense, it is because of mistakenly committing an undefiled offense." Now this treatise, relying on intentional transgression, says that a non-learner has no offenses committed.
