The vertical refutation of the view of both existence and nonexistence, and the view of neither existence nor nonexistence, is shown in its characteristics as above in the bodhicitta section, under the explanation of the name in 'transcending relativity'. If you say the mind both arises and does not arise, what sort of both arising and not arising is it? Is it that views do not arise while the real arises? Is it that desires do not arise while the real arises? Is it that habits do not arise while the real arises? Is it that dust and sand do not arise while shared functions arise? Is it that avidyā does not arise while the middle way arises? Is it that internal karma does not arise while external karma arises? Is it that internal retribution does not arise while external retribution arises? Is it that lesser practice does not arise while great practice arises? Is it that partial principle does not arise while perfect principle arises, such that you speak of both arising and not arising? If it is not these kinds of both arising and not arising, what could it be called other than a view?
