Forty-one: Knowingly taking and using water that contains living creatures commits an offense of pāyattika. The monk Chanda thought to himself: 'Pouring [water] on mud, grass, and earth was previously disallowed. Now, using it for myself should not be an offense.' He then used creature-bearing water as he pleased. People asked: 'Why do you use this creature-bearing water?' He replied: 'I myself am using the water, not using the creatures.' For this reason, it was again formulated. If water contains creatures, all [uses] violate this precept. If, in pouring it on mud, grass, or earth, it is said to have creatures: if one conceives it to have creatures, or conceives it not to have creatures, or if one has doubts, using it commits an offense of pāyattika. If it has no creatures, but one conceives it to have creatures or has doubts, using it incurs a duṣkṛta. If it has no creatures and one conceives it not to have creatures, using it is entirely without offense.
