2.33

無根謗戒　比丘自言犯婬。有比丘以無根盜謗者亦僧殘。互作勿應知　十誦云。比丘以無根謗尼突吉羅　四分僧尼相謗皆殘　後戒亦如是。假根不假根為異也。

The precept against groundless defamation. If a monk says of himself that he committed sexual misconduct, and another monk defames him with a groundless charge of theft, it is also a saṃghāvaśeṣa. Mutually switching [the offenses] should be known in this way. The Daśādhyāya-vinaya states: “A monk defaming a nun groundlessly incurs a duṣkṛta.” The Caturvargika-vinaya states: “Monks and nuns defaming each other all incur a saṃghāvaśeṣa.” The subsequent precept [concerning defamation taking pretext] is also like this, differing only in whether it borrows a pretext or does not borrow a pretext.
