Precept five: spending the night exceeding the limit with an unordained person. Formed by five conditions: First, an unordained person; men, women, and other nuances are as elsewhere explained. (The *Mātṛkā-śāstra* says: having already spent two nights with a śrāmaṇera, on the third night spending the night with a woman, one incurs two pāyattikas.) The second, third, and fourth conditions are the same as the previous precept. Fifth, exceeding three nights constitutes an offense. The vinaya says: Having spent the night together up to the third night, before the sign of dawn appears, one should get up and leave to avoid it (according to this, not leaving incurs a duṣkṛta); by the fourth night, either leave oneself or send the other away. The *Samantapāsādikā* says: By the third night, if before the sign of dawn appears one does not avoid it, there is also no offense (meaning one does not incur a pāyattika); on the fourth night, in the first watch of the night, as one's ribs touch [the bed], a pāyattika is incurred. The *Daśādhyāya-vinaya* says: If sitting throughout the night, or if ill, one may spend the night with a śrāmaṇera exceeding the limit; lying down is permitted for a sick person; other bhikṣus who are not sick should not lie down. The *Vinayamātṛkā* says: By the third night, if there is nowhere to go, the bhikṣu should not lie down, but sit cross-legged until the sign of dawn appears; by the fourth night, if there is again nowhere to go, when the sign of dawn is about to appear, send [the other] away, or leave oneself (according to this, one must depart on the fourth night; if one merely sits during the first watch, it does not constitute an exception). The *Pañcavargika-vinaya* says: In cases of non-offense when spending the night together: constantly sitting without lying down, or alternating lying down for half [the night] (this does not mean guarding against the dawn; in all cases where one does not lie down throughout the four nights, it is permitted). The *Mahāsāṃghika-vinaya* says: By the fourth night, due to reasons such as a great assembly or traveling along the road, one hangs a partition curtain as in the previous precept; if not, exceeding three nights is an offense. Once the offense is committed, if one has not yet repented and spends the night together again, the offense progressively increases, and there is no allowance of two nights; having repented the transgression, one must spend the night in a separate room, and then one obtains two more nights. The *Sarvāstivāda-vinaya-vibhāṣā* says: There are four permutations. Either the person is one and the rooms are different, or the room is one and the persons are different, or person and room are both one or both different—all incur a pāyattika. In the vinaya, spending the night exceeding the limit with a male animal incurs a duṣkṛta; the conditions of allowance are the same as above.
