Seventh: A custodian acting as the owner. The Samantapāsādikā states: Stealing a person without committing an offense refers to a master's child who has fallen into destitution, who was sent away by his parents, or whose parents are dead, or who is in debt, etc.; taking him away incurs no offense (based on this, privately ordaining someone who evades royal taxes brings merit and no offense). Stealing a slave incurs a grave offense. The Daśādhyāya-vinaya states: A watchman gave a robe to a bhikṣu; the bhikṣu doubted, not knowing whether he counted as an owner or not. The Buddha said: Simply accept it according to the giver; one is not permitted to beg for it from him. The Dharmaguptaka Vinaya states: Another person's custodian gave clothing and goods to a bhikṣu; the Buddha said, "This person is indeed an owner; he may receive them." The reason one is not permitted to beg for it from him is that the property belongs to a different owner; if he gives it upon being asked, that would be instructing another to steal property.
