Under the second condition. The vinaya has four propositions: Perceiving it as having an owner constitutes a grave offense (the first proposition); if one is in doubt, it is a sthūlāccaya (the next proposition); for goods without an owner, perceiving them as having an owner or having doubts constitutes a sthūlāccaya (the third and fourth propositions). It omits the third proposition of perceiving it as having no owner; based on the "Maintenance and Violation" chapter below, the meaning must encompass it. In the text, the first part marks the conditions constituting an offense, which is the first proposition. "If..." and below selects the lack of conditions, which is the third proposition; it first addresses how fundamental delusion incurs no offense. "Earlier..." and below is based on the shift in perception. If one earlier formed the perception of it having an owner, and later shifted to having no owner, one incurs a sthūlāccaya; if one earlier formed the perception of having no owner, and later shifted to having an owner, it constitutes a pārājika; hence it says they mutually incur light and grave offenses. The two propositions on doubt and discrepancy of object both appear in the subsequent chapter.
