When the father is incapacitated, the eldest son should manage the affairs of the household, or the next brother who knows the work, with his permission; but there is no division of inheritance while the father is unwilling. When he is old, of unsound mind, or chronically ill, the eldest alone should protect the property of the others like a father, for the household is rooted in the inheritance; those who have a father are not independent, even when the mother is in that condition.

If the father is incapable, the eldest should manage the family's affairs, or the next one who knows the business, with his consent. There is no partition of the estate against the father's will. If he is old, of unsound mind or long ill, the eldest should look after the others' property like a father; for the family rests on the estate. Those whose father lives are not independent, nor while the mother lives (with the property).
