In sexual misconduct, the text also has three parts: first, stating the general phrase; next, separately explaining the eleven phrases; and finally, summarizing them briefly. The eleven phrases are: 1. guarded by parents and others; 2. self-guarded; 3. subject to legal penalty; 4. termed an impediment—these four types are all unmarried, and the treatise condenses them into three kinds of guardianship; 5. another's wife or concubine; 6. claimed by another; 7. if by treachery; 8. if by force; 9. if by stealth; 10. engaging in sexual conduct; 11. engaging in misconduct with an improper lustful mind regarding this matter. For the culmination of the path of action of sexual misconduct, this means the act of intercourse is completed; with one who is not one's own wife, the path of action is accomplished. "Improper passage" has three meanings: first, an improper passage to traverse, meaning body parts other than the birth passage; second, improper amount, exceeding the limit of five times; third, improper manner, meaning engaging [in intercourse] contrary to the standard norm, as well as with all males and non-males. Thus, the fifty-ninth fascicle says: improper intercourse, improper amount, improper manner, and inappropriate [person]—males and non-males. "Improper place" means places where the Buddha, Dharma, and Saṅgha reside, the bed of one's parents, uneven ground, and so on, such as in a saṅghārāma. "Improper time" means when she is ill, pregnant, nursing a child, and so on; during the three bright [lunar phases], the six dark [phases], and so on, as explained in detail by the fifty-ninth fascicle itself. When these described [acts] occur with one's own wife, they also accomplish the path of action, because the intention is grave.
